Ecuador Constitutional Court Upholds June State Of Exception

Ecuador's Constitutional Court issued a favorable opinion on June 26, 2026, backing the state of exception declared by President Daniel Noboa.
The ruling validates Executive Decree 423, signed on June 16, 2026, and allows the security measures to remain in effect in selected jurisdictions.
What The Court Validated
The measure has a total duration of 60 days and applies in 10 provinces.
The ruling also covers three specific cantons where authorities identified critical insecurity levels: La Mana in Cotopaxi, Las Naves in Bolivar and La Troncal in Canar.
The court based its decision on technical reports from the National Police, the Ministry of Interior, the Armed Forces and ECU 911.
What Measures Remain
The court backed measures including Armed Forces support for police operations, temporary suspension of the inviolability of domicile and correspondence, and the ability to requisition legally sourced goods.
The state of exception does not include a curfew. Residents may move freely, although security operations, controls and checkpoints remain in place under law-enforcement planning.
What Is Still Pending
The court is still reviewing Executive Decree 424, related to recognition of the internal armed conflict and international cooperation.
No final decision has been issued on that decree yet.
